h1visa2012 Posted May 24, 2013 Report Share Posted May 24, 2013 Hi Experts, I have used 4 years of my H1 and returned to India 6 days before my H1 expiration. First H1: Oct 2007 - Dec 2008 Entered US in August 2008, this is because I got an RFE and h1 got approved in only in June- 2008, but the visa validity was from Oct 2007. Second H1: January 2009 - Dec 2011 Used this full 3 years and left US in Dec 2011. Questions: Now it is been 1 year and 5 months I am out of US. Am i cap exempted? Since I entered US after 11 months after start date, can i get those period also added when i get the next H1? Please help Link to comment
