jan15 Posted May 2, 2013 Report Share Posted May 2, 2013 Hi , My husband is on L1B and I am on L2 - I have been working on L2. Our L1/L2 visa expires on Aug 2013 but his I 94 is valid until 2015 . My husband's company has applied for H1B ,(on april 2013) Change of status. So if his H1B visa is approved can he still continue to be on L1 , I 94 - that is valid till 2015 ? Can anything be done now , so the application indicates not change of status? Thanks Link to comment
Attorney_10 Posted May 2, 2013 Report Share Posted May 2, 2013 Generally, once a change of status is approved the beneficiary's status will change to the new status upon the start date on the approval. Once the change of status takes effect, the beneficiary will only be permitted to work for the H1B employer pursuant to the terms of the H1B petition. In addition, all L-2 dependents must also have filed change of status applications or they will be out of status. If an individual on L-1 does not want his/her status to change, then the H1B petition should be filed for consular notification.
