My company filed for my H1B extn in premium processing and i got RFE this week. I have few queries here. 1. Can i travel if my extn is in processing ? 2. Can i re-enter US, if my H1 B extn status is still pending (I Have valid petition and VISA till July 2012) ? Link to comment
shilpasrinivas Posted March 13, 2012 Report Share Posted March 13, 2012 I had similar situation. I traveled while my extension was pending. No issues in travelling to India. But you have to get stamped before returning back (you have to wait in india for your approval, stamp and return back) Link to comment

I guess if you have a stamp already in ur passport for the visa valid till july 2012, you need not go for stamping. But if you do not have the stamp in passport for current visa valid till july 2012, you have to go for stamping. If you wait for extn document and go for stamping, then you are good with your passport as long as ur extn date is there..which means next time when you travel out of usa, you need not go for stamping again for re entry, because you are getting stamped for the extension visa. either case, choice is yours...but you are good...
