I485 applied, what happens if dates retrogress?

Hi All,

I have applied for my AOS in Dec. From the March bulletin updates, it seems the date will still stay current for my PD. But what will happen if in April, the dates retrogress beyond my PD, and my I485 still has not been approved till that time?

Will my application still be processed, or will I be put on hold till my PD again becomes current?

Once you file your I-485, retrogress does not affect your application.

When the PD retrogress, your application will move only upto decision stage (means, only evaluations will continue. no decision will be made). During this period, candidates might get interview letters/RFE, if applicable. In some unfortunate cases, denials will also occur. Once the PD become current, the decision will be made, probably in the very first week.

Please see above comment. Forward moving doesn't mean not enough eligible candidates, but fewer eligible candidates filed application. This is what happend in the past 3-4 months. Everyone is hoping to continue this movement at least by weeks. Even stop movement is better than retrogression. However, a bunch of candidates suddently file their applications (say candidates have PDs 1/1/2009 or prior), date has to retrogress. I can see this type of filing al least in some cases (Some filing occurred in Jan-12 but date became current back in Nov-11). These days, we are seeing new application approvals from PDs become current in Oct/Nov, which is a good sign.

If dates retrogress and someone's case gets stuck, can that person at least use AC21? Or, is even that not allowed?

Sorry, I did a Google search and the only thing I found was a 2005 artice on Murthy dot com.

You can change the job after 180 days of filing 485 application. People have 485 applications pending for many years and this option is always good choice for them to move forward in their career.
