H1b Transfer

Dear members

I had a question related to H1b transfer.

My company has agreed to sponser my H1b visa this april 2012. I am currently on my OPT stem extension which expires May 2013

My question is that suppose my H1b application gets approved in april can i change employers by H1b transfer or do I need to wait till October for the H1b status to get activated before I can switch jobs. I am aware that there could be some complications but wanted some clarity on possible options

Any comments will be absolutely welcome

Another employer can file for you at any time using the same annual cap number once the first employer's application gets approved. But H1 start date cannot be earlier than Oct 1, 2012.

However if the second employer is also enrolled in eVerify and the job is in your field of study, you can join them on OPT extension before Oct 1.

Status complications are involved in such applications and make sure you get some advice before you proceed with any plans.
