KNJ
I am currently on h1b with a big US manufacturing company since last 2 years and have been put on a 6 week soft improvement plan with certain goals and actions. Failing to achieve this I will be put on 90 days Performance improvement plan (PIP). I don’t want to work there anymore because of my medical condition which comes under disability and want to take an FMLA before I am on PIP at the end of the 6 weeks. My question is can they fire me while I am on PIP because of some slack in my performance before going on FMLA? Can I maintain my status on FMLA from India? Quote Link to comment
Attorney_20
This is not a U.S. immigration law question. It sounds like you should speak with a labor & employment attorney practicing in the state where you are working. Quote Link to comment
