Nandagopal K Posted September 3 Report Share Posted September 3 (edited) Hello Everyone - I have filed the EAD (Form I-765, Application for Employment Authorization) for my spouse as a standalone process on 16, Feb 2024 against my current petition which is going to expire on "02, Dec 2024". But till now, we haven't received any update from USCIS on the same. Here, I am not sure whether we will receive the update from USCIS before my current petition expires because the processing time from USCIS keeps changing week by week. So, need all your suggestions / clarifications on the below queries - By any chance, USCIS will consider my recently filed H1B extension # as source for my Spouse EAD (I-765) processing instead of my current petition (about to expire on 2nd Dec 2024)? If point # 1 didn't work, Can I withdraw my spouse EAD (the one filed) and can we freshly file it against my recently filed petition? We are in a baffled state of mind and need your assistance on this situation. FYIP – I have recently filed my H1B extension on June 2024 and it’s in progress.
