randomWagen Posted May 24 Report Share Posted May 24 Hi, I got into trouble 2 years back and due to that I got a record which is lower level Felony assault charge with negligence, now its not a CIMT or any other inadmissible offense. What one lawyer are saying is you can be denied visa in discretion but another lawyer said as you are not inadmissible and H and L visas don't have discretion as they are dual intent visas, they can issue 221g and after documents review give the visa. I wanted to understand from people's experience can H1b visa be denied without any reason like without any 212 clause being applied ? Quote Link to comment
