locotaco
I resigned from job from employer A on Sept 20. have pay stubs till sep20. Just got a new offer from company b willing to file h1b. But background verification and filing of lca/h1b will take couple of weeks. What is the best way to not acrue unlawful presence. I have valid i94 for 2 more years and approved i140. Can company B file my h1b if i go back to India. Quote Link to comment
User099
60 days from Sept 20 before you are considered unlawfully present. Yes, Company B can file for your H1 even if you are India. Edited November 14, 2019 by User099 text Quote Link to comment
