Parthas002 Posted February 14, 2017 Report Share Posted February 14, 2017 I am now in USA and my wife is in INDIA and last year she got H1B and recently got stamped but she doesn't have project for travel. So I am planing to get her for H4 stamping, so that she can travel to USA. Once she is in USA if she gets any job, can we change the H4 to previous H1B? Link to comment

JoeF Posted February 15, 2017 Report Share Posted February 15, 2017 So, the employer lied when he filed the H1? As part of the H1 application, there had to be a client letter, showing that a project is available. Unless she starts working for the H1 employer, she is not considered counted for the quota. So, a new employer would have to file an H1 in the quota. And she should stay away from shady consulting companies that break the laws. Link to comment
