Kalpana Arun Posted January 31, 2017 Report Share Posted January 31, 2017 We have a disabled minor who is born here. We have an approved I-140 and waiting for the priority date. We would like to if there are work authorization for the Mother /Expedited route for Green Card. Currently she is on H4 EAD but with the expectations that the new Executive Order could take out the Spousal EADs, we are worried if the primary applicant visa extensions get into any issues we cannot take the baby out of country(he is on ventilator with 24/7 nursing) and potentially could go out of status. JoeF Posted January 31, 2017 Report Share Posted January 31, 2017 Sorry, having a US citizen child does not give the parents any immigration rights. The only option maybe possible would be humanitarian parole. Talk with a good immigration lawyer. Link to comment
