Now her H1 is picked in lottery and waiting for the approval. The H1 is applied by another employer and not the one who is now employed with. Once the H1 is approved, can she continue working with the current employer for some more time before switching to H1? Kindly help. Thanks. Link to comment
JoeF Posted August 31, 2016 Report Share Posted August 31, 2016 If the H1 is approved with COS, it starts on Oct. 1 or the approval date, whichever is later, and the H4 and the H4 EAD will be invalid from that day on. She then will have to start working for the H1 employer. Link to comment

Currently the H1B application in RFE, and the employer is in the process of responding for the RFE. So, until we get the approval notice in hand, I believe she will be able to continue her current job. Let me corrected if my understanding is wrong. Also, by the time it get approved, if the current employer is ready to work with the H1B sponsor employer as a contractor, then how much time it will take to switch between EAD to H1B by continuing the same job. Is that going to be an amendment for client/location change for the H1B? Your kind inputs in this will be appreciated. Thanks Link to comment
JoeF Posted September 1, 2016 Report Share Posted September 1, 2016 The H1 employer had to provide a client letter (if it is a consulting company.) She has to start working at that client location when the H1 starts. Only then can the location be changed. Link to comment
