  1. Lawyers maybe helpful. In my case the lawyers filed H1,H4 and EAD concurrently. It was a premium processing but the H4 got an RFE because of a missing marriage certificate. It’s no use for me to play the blame game. In any case USCIS has received the RFE response and the H4 extension and H4 EAD is back in the normal processing line. So to answer your second question give yourself at least 3 months for processing times. You can check processing times on the USCIS website. Have you thought about you and your spouse going abroad to a neighboring country to stamp your H1 and H4 visas? This way you can avoid waiting for I539 approval and file a stand-alone H4 EAD when you return.
