[Request Advise] - Apply for H4 and then EAD when H1 RFE is not responded ?

Hi,

 

I genuinely need your help in my H1 case.

 

My H1 extension was Filed on June 18,2015 and it expired on July 21,2015.

It went to RFE on Feb 10,2015, lawyer responded around March 4,2016.

Case was upgraded to Premium around April 15,2016. But it again went to RFE for additional project documents. 

 

Meanwhile I will complete 6 years of US stay by this May 23rd 2016.

My Perm - Filed on March 10,2015, not yet approved.

 

My Spouse's is working here in USA and his I140 is approved.

 

So my question is can i go back to India and come on H4 and then apply for H4 EAD while not responding to My H1 RFE ?  Will it have an impact on my H4 EAD if the H1 RFE is not responded ?
