Travel on pending I-485

Hi,

My husband has filed I-485 under eb1. Our I-140 is still pending . Both of us has valid h1-b extension but need to go for visa stamping if travel outside. We need to travel outside of us due to family emergency. Can we travel without any issue on pending I-485. Please let me know.

Your i 485 will be adjudicated at its own pace. So will your EAD and AP. If you leave the country and your AP were to be approved then you wont be able to use it for immediate return. You have to enter US in some other non immigrant status to start using EAD/AP.

 

    I have applied for my H1 visa at US consulate while I 485 was pending and was approved without any issues. There is a question in your DS forms asking if there is an immigrant petition pending. Answer it correctly.
