Change Job as soon as I get EAD

Hi Attorneys,

 

Can I change jobs as soon as I get EAD card ? 

 

I am eligible to file for AOS and AP as per Oct 2015 visa bulletin.

 

I worked for the current employer since 9 years. Looking for new opportunities while still employed with current company.

I to have the same question.

and if we can change company what about the GC Process ?  Will it be valid to move to a different company and expecting GC from old employer

I just found the answer myself.

 

So our question itself is incorrect here.

 

It is not the EAD that decides whether we could change Jobs or not.

 

It is the I-485 application which has been pending for more than 180 days, that decides whether we could change jobs or not.

 

So for example, we file I-485 on October 2nd, 2015 based on October 2015 Tier-2 PD 1 July 2011. The we can change jobs 180 days after October 2nd 2015. I.e approximately first week of April 2016.

 

Note: Though we might get EAD in between Oct 2015 and April 2016, but it does not decide whether we could change jobs or not.

 

Assuming that you don't get Green card before April 2016, you can change jobs then on your EAD.

 

If you get Green card before April 2016, then you can change jobs anyways on your GC.
