gcnyc1 Posted June 16, 2015 Report Share Posted June 16, 2015 I have a question, please provide your input. I'm on H1B and have I-140 approved. H1B expiring Feb 2016. Spouse on H1B working now. I want to apply for h4 EAD. Planning to file three forms together in Aug 2015: I-129 for my H1B extension, I-539 for spouse change of status from H1B to H4, and I-765 for spouse H4EAD. My question is Should I file my I-129, and spouse I-539 in premium processing in Aug 2015, along with I-765 requesting spouse H4 starting date in Feb 2016. This way there will be enough time for my spouse to get EAD approval assuming my I-129 and I-539 gets processed in 3 weeks with Feb 2016 starting date for H1B and H4 (approximately 5 months). Please respond if this is possible. I'm trying to avoid gap between H4 and EAD such that there is continuity in employment. Link to comment

Also is it better than applying all (H1, H4 & EAD) together... Even if filed together EAD application processing will start only after adjudication of COS to H4 petition. And, there is no way a start date for H4 can be requested. Link to comment
