I haven't been able to get a project since then and my employer is planning to revoke my H1B. Meanwhile, two months ago, I got EAD and AP thru my spouse's GC EB2 petition. In case my H1B is revoked, what are my options? Do i need to file a COS to H-4 to legally stay in the US? Also, in case my H1B is revoked and I don't file H4, can I stay on EAD only due to pending I-485 petition and in that case, do I have to actually start working somewhere to maintain 'an EAD status'? JoeF Posted March 13, 2015 Report Share Posted March 13, 2015 You can't get an EAD through your spouse. You can only get it if you ha e filed an I-485 as dependent. Have you? If you have a pending I-485, that keeps you legal. The EAD is just work authorization, and AP allows you to travel abroad without abandoning the I-485. Link to comment
