H4 to h1 Transfer

Hi ,

 

I have a Masters degree from USA.Was on H1b from 2006 to 2009 and h4 from 2010 to 2014.

Do i come under H1b transfer or need to go for new H1b visa.

If at all i still come under new H1b visa, do i still come under Masters quotacap.Please advice.

You are cap exempt.

You don't need to go with new H1b. Your employer needs to file your H1b with COS ( from H4 to H1b). Once approved, you are good to work. You cannot start working on receipt though. 

Once counted towards cap, you are entitled for 6 years of H1b.

Well..there is nothing as H1 transfer.An employer can file a cap-exempt petition for you using the old cap number and you will get 6 years minus the time you spent in US on H1.If you want file a cap subject petition you will have to wait till next yr when the quota opens and you will come under masters exemption.
