Filing L2 to F1 COS after L2 to H4 has been filed

Recommended Posts

I am currently on L2 visa and my husband is on L1 visa

My husband's H1 got selected in lottery and his company has filed L1 to H1 COS along with my L2 to H4 COS.

Now i got admitted into a school and want to convert to F1 visa as soon as possible.

What would happen if i file L2 to F1 COS now.

I have a fear  that lets say if my L2 to F1 COS gets approved and then USCIS also approves L2 to H4 COS then i will lose my F1 status.

Or if by luck both COS applications get approved on the same day then what will be my status.

Will the law of 'latest application will be considered' apply here.

Experts Please advise

Last action rule will apply. I would suggest you to exit and enter US with a F1 visa and in this way your COS to H4 petition is considered abandoned.
