J1 visa - 2 year HRR clause

I am a research scholar on a J1 visa at a prestigious institute in organ transplant surgery.



 



1. I am on a J1 research visa with no federal or home country funding.



2. My visa is not sponsored by ECFMG nor am I in a clinical position.



3. I am managing all my expenditure in the US using private financing.

All these points are mentioned on the DS2019 too.The program subject code listed on my DS2019 is not listed under the 2 year HRR clause list by DoS website. (http://travel.state.gov/visa/temp/types/types_4514.html



 

I have already applied to DoS for an ADVISORY opinion regarding my 2 year HRR clause. Is there any way I can get the clause off my J visa, so that I can change to a H-1 visa for pursuing clinical fellowship in transplant surgery?

You need to wait for advisory opinion from DOS. If the answer is yes then you have to initiate J1 waiver process.
