Upgrading I140 to premium processing

Hi ,

 

Got RFE on I140 EB2 (porting from EB3) case which was not answered by Employer.  Expecting a denial notice so that it can be refilled but it's been almost 45 days and counting waiting for the notice.

 

At this point, Is it ok to upgrade the case to premium processing to get a response within 15 days to eliminate the waiting period or should wait for few more days/week ?

By converting to premium are you (planning to) asking for denial? Dont know what options you have, but not responding to RFE and then converting premium doesnt make sense to me.
