Maters in US--No OPT--H1B Visa chances?

Hi all,

 

One of my Cousin completed her Masters in US May 2012 but later for some family issues she left India without taking her OPT.

 

My questions are:

 

1) Can she apply for H1B this April 2014 -- If yes what are the options?

2) If at all we plan to apply does she come under MS quota?

 

Can you please tell me the options?

 

Any help is greatly appreciated.

1. Yes, she needs to find an employer who would file her H1B petition

2. If her studies are from non profit, accredited university then she is eligible for Master's quota.

1) Can she apply for H1B this April 2014 -- If yes what are the options?

 

  • No she cannot apply for H1B, only her US employer can apply for her H1B, so the first step is going to be, find a legitimate job in US and then the employer can apply for the H1B. 

 

2) If at all we plan to apply does she come under MS quota?

 

  • Again there is no WE applying for anything, as has been said above if she graduated from an accrediated university, then her employer can apply for her H1B under the Masters Quota

 

Can you please tell me the options?

 

  • Have her find a legitimate job/employer and then have them apply for H1B
  • Then there is always family based, marriage based, finace and other dependent VISAs but I do not think you are talking about those in this case.

2. If that degree is from accredited university then she can file under master's quota.

It has to be an accredited, public or non-profit private university for the Masters quota.

A degree from an accredited for-profit university would not qualify for it.
