prax_atreya
Friends, I am currently working as Lead Software developer in my current position and I am currently on H1B Visa. I am employed with my employer for the past 5 years all inside USA (2 years in L2 visa + EAD and 3 years in H1b Visa). I got promoted as Manager with 4 people reporting to me recently. My question is will I be eligible to file my green card in EB-1 category.? Thanks in advance. Regards, Prakash R Link to comment
catx
EB-1 executive / manager preference category requires that you (1) work for an employer with international operations, e.g. a U.S. company with operations outside the country or a foreign company with U.S. operations, and (2) you were a manager in the employer's operations outside the U.S. for at least 1 year before coming to the U.S. in the same capacity (managerial job). Merely being a manager in the U.S. does not qualify, so the answer to your question is no. Link to comment
