mahesh.sahu75 Posted August 1, 2012 Report Share Posted August 1, 2012 Hi All, I will max out my 6 yrs of H1B visa in April 2013, my Employer has started the GC process, but by the time they file labor it will take another 5 months after that i'll have only 4 - 5 months for Labor to be approved, in case labor is not approved by April 2013, i'll have to move out of country for 1 year. Can someone advise on what are my options? Though my H1B will max out in April 2013, i've not stayed all all the days in US, for example; i've taken vacations to India with in my stay and that counts to 5 - 6 months. Will the vaccation to India / gap will be counted towards my 6 yr H1B Visa? Can i apply for H1B extension for this gap of 5-6 months? Regards Mahesh Link to comment
