How difficult is this compared to moving from OPT to h1b. also is travel out of US safe enough during this transfer period. Link to comment
JoeF Posted January 18, 2012 Report Share Posted January 18, 2012 If you have an H1 from a cap-exempt organization and haven't been counted for the quota yet, you could only apply for an H1 in a non-exempt company from April 1 on, for a start date of Oct. 1. Chitown01 Posted January 18, 2012 Report Share Posted January 18, 2012 From what i understand you are currently on an H1B with an institution that is NOT Cap Subject..... There is nothing like Transfer, there is always a new petition, however since you were NOT counted towards the CAP in your Past H1, you will have to wait till April 1, 2012 to file for new CAP Subject H1. If your new Company is legit and all paperwork is in Order nothing to worry.. One should NOT travel outside the US when the petition is pending. Link to comment
