aquatican Posted January 18, 2012 Report Share Posted January 18, 2012 My 6 Year Time Limit is done on January 16,2012 Previously I applied with Company A for PERM and I140 And The PD was Jun 2009 Company A layoffs in Jan 2011 caused me to switch. Then i switched to Company B and was granted Extension till Jan 16,2014 Now I have to switch again to Company C and my PD is going to be current in February due to Feb Bulletin. Since my 6 years are up what happens now? Considering Approved I140 but PD is current. ( in Feb) Will I retain my H1b extension till Jan 2014 ? Link to comment
vmaha Posted January 18, 2012 Report Share Posted January 18, 2012 I had started topic for same situation and attonrney replied on that. After that this is 3rd occurance of similar case. after PD is current only 1 yr of H1 extentions are allowed. any further extentions are dependant on I140 remaining valid too. So if you are switching to company C, you will get 1 yr of H1 and company C has to start PERM asap but then also it will mostly need one more year of h1 extention and that time your old approved 140 should be still active (not revoked) Link to comment
