Chaithra_L Posted January 10, 2012 Report Share Posted January 10, 2012 Hi, I had an approved H1-B (filed in 2009) from company A, which was valid till Dec 2010. In the meantime, I travelled to the US on a H4, at which time my H1-B was marked 'cancelled without prejudice'. Currently I am in the US and am looking for job opportunities. My question is, is it possible for an employer to 're-sponsor' my H1-B right now or would I have to wait until April 1, 2012 to get a fresh visa? What are the other options I have, ie, L1 etc? Chitown01 Posted January 12, 2012 Report Share Posted January 12, 2012 Since your H1 was approved in the past, you were counted towards the CAP so if you find a new employer and they are sponsoring you they can file a new H1 petition on your behalf which will be CAP EXEMPT, however you CANNOT Start working with them until you receive Approval Notice. Chitown01 Posted January 17, 2012 Report Share Posted January 17, 2012 Since you are in the US on a vald h4 status, your H1 will be filed with Change of Status, upon approval you will receive a new I-94, and that should be good enough... But if you travel outside the US, and want to re-enter on H1, you will need to get H1 stamped. Link to comment
