h1 b status question

hello

i have a question about being out of status.

i had applied for my 7th year extension in june 2011.In august my employer had suggested i apply for a second visa from another employer as a back up and i had applied for the 2nd visa when my first visa extension decision was pending.i recieved a denial for my first visa on 21st nov 2011..and recieved an RFE for the 2nd visa..if my 2nd visa gets denied ,will i be considered to be out of status from the time my i94 expires..which is june 26 ,2011 or from the time i receive a denial notice of my 2nd visa.
