Petition cannot be found with USCIS

Recommended Posts

Hello,

My lawyers submitted the H1B transfer (PP) petition to USCIS on Wed 12/7. Fedex confirmed the delivery. however, we did not receive receipt until yesterday (12/12). My lawyers called USCIS today and they were not able to find the petition.

USCIS will try and track the petition internally.

1. Anyone else in the same boat?

2. Does any one know approximate time they take to respond back?

3. What are my options?

Thanks.

the same thing happened with me...however USCIS was able to then track the application but returned it saying it was missing a document which was infact there in the package itself.

When the lawyer sent it back they rejected it saying the cap is over....hope this was helpful..

@pranave - did your lawyer re-apply?

@mgandhi - I had a few questions for you:

1. How long did it take for USCIS to track the application?

2. Did they get back to your lawyer or your lawyer had to call them to check status?

3. In how many days did u get the application back stating document was missing?

Thanks for taking time to answer my questions.

Hello Pranav and mgandhi.... here is an update from my side....

the lawyers sent the application to Vermont Processing Center as opposed to California Processing Center. Vermont reject the application and sent it back to the lawyers. Lawyers have re-filled with California Processing Center...

Will keep you guys posted.

Hello Pranav,

Did your lawyers also sent to VSC instead of CSC??

Is your new H1 or transfer (change of employer)???

In my case VSC sent application back to my lawyers and lawyers re filled with CSC

If yours is transfer, they will accept the application

I'm not sure about the new H1

they found my application a day before the quota was going to run out! and sent it back stating missing documents.

When the package returned the documents were found in it. Documents were sent the same day however case got rejected at USCIS stopped accepting application till then.

Hello khm123,

I think due to holiday season, they are taking time.. Usually within 15 calendar days they will get back to you with something or the other else Premium Processing Fee will be refunded :)
