av412 Posted December 3, 2011 Report Share Posted December 3, 2011 I-129 & I-539 applications for extension of our H1-B / H-4 (expired on Nov 16, 2011) filed on Aug 17, 2011, and are pending. Can we proceed to India now on the basis of the filing receipts? will there be any issue at the time of visa interview for stamping at the U.S. Consulate in India or at re-entry at the airport in the U.S. since the I-94 we would have surrendered while leaving the country would have been stale?
