Venkat5078
Dear All, I was allotted a H1 B petition and got stamped for the Visa in 2007, due to the hostile circumstances my employer discouraged me to travel. Now a US employer is ready to hire me, my question is still can i utilize the petition of 2007. Your answer will help me in moving my cards faster. Thanks and Regards, Venakatesh. Link to comment

Venkat5078
Hi, Thanks for the response. Sorry, I forgot to mention 1 thing. Over the petition the validity date was 21-Oct-10. Is the H1 petition valid for 6 years ? Regards, Link to comment
livliv
Since you have not used any time out of the total 6 years, (assuming you did not travel in L1 status) your new employer can use the previous cap number and file a cap exempt petition. Link to comment

livliv
If you have not spent 6 years in the US in L1 status, any employer can file a cap-exempt H1 petition for you. Link to comment
