Amandagrooves Posted April 30, 2021 Report Share Posted April 30, 2021 I got my first H1B petition approval receipt on 28th April’2015 and a valid H1B visa from 1st Oct'2015 to 30 Sep'2016. I travelled to US in July 2016 and applied for an H1B extension while my stay in USA. The extended H1B was valid from 26th Aug 2016 to 01st May 2019. However I relocated to India on 20th May 2018 and have been staying in India since then. I wish to apply for an H1B Not Subject to CAP (H1B CAP Exempt) from India, could you please help me with the below query ? " Am I eligible to apply for H1B CAP Exempt to use the remainder 4 years of my H1B ? Is there any date within which I should apply for HNSC from India, post which (beyond that date) I will never be able to use the ‘Unused’ period of approximately 4 years of my H1B visa?
