Raj_me Posted January 13, 2021 Report Share Posted January 13, 2021 My wife's passport that was used for her last entry to the US is expiring on Feb 16th 2021 and so is her online CBP I-94. After entry to the US, she changed her employer on H-1B visa status and currently has a valid I-797 from her new employer with an attached I-94 valid until 2023. However, since she didn't travel outside the country, her online I-94 is still going to expire on Feb 16th 2021. In this case, do we need to file for an extension with USCIS by filing form I-539 or we don't need to take any action since her I-94 attached to her new I-797 is valid until 2023? Any advice would be really appreciated! Quote Link to comment
