Ps1234
My initial h1b was approved in July 2019 and we filed an amendment in Oct 2019.On Oct 1st, 2020, my initial cap-subject H1B is revoked by USCIS as we filed the amendment 10 days late.In the revocation notice, there was no mention of the finding of fraud. But they also sent notice of intent to deny for amendment and one of the reasons says I'm not cap-exempt.Before we get the notice, another employer filed an H1b transfer for me in premium and it is approved with i94.Will I get another intent to revoke for this transfer if I'm not cap-exempt or I'm good for now? JoeF
You need to discuss this with an immigration lawyer. If USCIS says you are not cap-exempt applications from another employer wouldn't work, either. Quote Link to comment
