i97 expired - Valid 797

Recommended Posts

Haven't travelled outside USA since January 2018. Employer filed for H1b extension on February 2018 and I have approved i-797 valid until August 2021. i94 expired on August 2018. New Amendment was filed again October 2019 and i-797 valid until August 2021. Passport got expired on June 2020 and I have a new passport valid until 2025 since March 2020. Should i ask the CBP to extend the i94 validity - What are my options here?

I am in the same boat, CBP will not extend just like this. Here is the response I got.

CBP cannot update an existing I-94 with a document (passport) that was never used for that travel. In order to receive an I-94 from CBP you must travel outside of the U.S. and make an entry.   Another option is to apply for an extension of stay with U.S. Citizenship and Immigration Services (USCIS) with form I-539.
