My dependents (wife & daughter) H4 is also expiring on 30th Sept 2020. As my wife is separately filing for H1, I was suggested not to process her H4 extension in parallel. In case my wife's H1 doesn't get approved, will it be possible to file for my dependents H4 at a later date (say Feb 2021), provided my H1 is approved. This will cause a break in their H4 status, which expires on 30th Sept 2020. Quote Link to comment
User099 Posted July 2, 2020 Report Share Posted July 2, 2020 It would be better to get a decision on her H1 by Sept 30th and if its approved them you are good. If not, you can file for H4 before her I94 is expired. You should file for H4 extension before I94 is expired even with the H1 in process.
