need_help_h1b Posted February 27, 2020 Report Share Posted February 27, 2020 I am currently on an F1 visa which is being terminated this week by my university since I am no longer continuing education. My husband's (on H1b) company attorney have applied for a dependent H4 visa in Jan 2020 for me and I just went for biometrics this week. Is my stay in the US still legal/valid with a terminated F1 and a pending H4 application? If not, what options do I have? The DSO and attorneys have different views on this. The DSO says I need to be enrolled as a student till H4 is approved. Attorney says they have not received any guidance from USCIS that non-immigrant status needs to be maintained until H4 is approved. Thanks in advance. Quote Link to comment
