Usaimmig
Hi , My I797 expired on March 05th 2019. My company had applied for H1B extension in January 2019. I had received RFE in March 2019 and responded to it. My case was then converted into premium processing in September. I was checking the case status online daily to be on track, on 20th September the online case status reflected that my case was denied. My company told me that they will count the days after they receive the hard copy and not as per the online update, so I waited for the hard copy until 30th September and left the country. My company received the denial hard copy on 04th October . My question is should my company run payroll until 20th September or can it run till 30th September , the day I had left the country. Please let me know if having the payroll run after 20th September until 30th will be an issue down the line , when I apply for my green card processing. thanks in advance! Quote Link to comment
User099
you are generally consided to be in status till you get the hard copy of the denial in your hand. So you are good till Sept 30th. Quote Link to comment
