vghegadi
Hi, can i switch my current employer when i have only 7 months left in my visa (7.5 yrs completed so far with I-140 approval). My impression is when i get my visa transferred to new employer, i will be getting a maximum of 7 months visa validity with new employer. Hence, i need to at least get PERM completed by new employer before i apply for H1 extension with new employer? In this case, looking at current timeline for PERM approval, i am not optimistic i will get PERM approval before its due for extension. Or, can the new employer can use my current approved I-140 (valid for 7 months) during my H1 transfer and get a maximum of 3 yrs of visa validity on transfer. Please guide me. Quote Link to comment
User099
Since you have a I140 which is approved for more than 180 days, you can use that to apply for H1 Transfer and get 3 years. Quote Link to comment
