I initially did Masters in Computer Science and completed 3 year OPT. Last year my H1 B got denied. This year my employer filed H1B as consular processing but I received an RFE on Maintenance Status. I am wondering if I could get such RFE when I filed my H1 as consular. If yes, what are the approval rates? Thanks, Sandhya Quote Link to comment
JoeF Posted July 19, 2019 Report Share Posted July 19, 2019 In a PhD program you do research 24/7, not working with CPT. So that seems to be fraudulent CPT. And there is no consular processing for an H1. All H1s are processed by USCIS. An H1 can be filed with consular notification. Quote Link to comment

Please let me know how your reply went. CPT has to be required by the curriculum, not just related to the studies. It is for required internships, not for working in some arbitrary job. Abuse of CPT will result in killing the future in the US. Concentrate on studying, not working. Quote Link to comment
