H1b Validity

Hi ,

I had my H1B visa filed in 2012 and i travelled to US from May 2013 to Jan 2014 and then returned to India.

Is my visa still valid as i haven`t utilised it completely? Do i file under cap exempt and stand a chance to get it renewed or any other way out.

Please help.

Hi, I believe yes you can utilize  renaming period at any time and apply for renewal.

I read in some other posts about clause of 6 yrs. Have i passed it ? Can i still renew . Please help me here.

Hi, Did you spend 6 year period in USA? if not I think you can use your period at any time. It's not about counting years from 2012 to till date instead how many years you spent in USA on H1B VISA. In summary, yes you may apply for renewal.

Thanks , not 6 yrs in USA infact just spent 10 months. As per your advise , i will try talking to some consultancy to help me with renewal. Thanks again.
