need Help. USCIS claims they never received the NOID response

HI

Filed for EB1A with TSC via attorney in Nov 2018, received NOID for which the attorney office states that they have responded appropriately within the time frame (33 days) and they also have the postal receipt confirming delivery. however now we receive a complete denial from USCIS , they are claiming they never received the nOID response.

 

is this a new strategy to refuse applications ? how can they deny petition without even looking at it ? what are my options ? my attorney is suggesting MTR. can i get a second opinion with another attorney at this stage ?
