Mchand01 Posted January 6, 2019 Report Share Posted January 6, 2019 My daughter I94 issued till her passport expiry date (7/7/2018) but her petition and Visa are approved till June 15 2019. I have renewed my daughter passport but missed to renew the I94 after 7/7/2018. Myself and my spouse have I94 valid till June 25th 2019 and our Visa approved till June 15 2019. My spouse is pregnant and due date is on June 11 2019. I am planning to apply H1 extension in premium. Pls advise what is the best action to take to handle the situation. Link to comment

My attorney asked me to apply for my H1 extension in premium and apply Nunc Pro Tunc petition for my daughter H4 extension. Also he mentioned she is not in unlawful presence and she is in out of status. USCIS will backdate the I94 date when they are approving her H4 extension request. Link to comment
