Travel to india

Hi, 

I am going to travel on 20th Jan and return back on 13th Feb. But my I797 is going to expire 0n 27th feb. 

My questions,

1. Is there any issue in port of entry?

2. What are documents need to be carried?

3.Not yet start to file for H1B Visa extension. Shall I say , i willl file once reached in US during port of entry..

With the info provided:

1. Yes. You may be denied port of entry because your i797 alone does not have enough validity. This is especially true if your visa is expiring on 27th as well.

2. Visa and a valid i797

3. You can say that but see 1.

 

Better to wait and let your employer file extension and come back with valid visa.

Also you have not provided enough info. Why dont you make use of your employer and their attorneys resources ? They are paid to do exactly this and they know more about your case details than any of us here.
