Amala Posted January 4, 2019 Report Share Posted January 4, 2019 Hello, I am on H1B visa. I have an approved H1B visa with validity date from 06/30/2018 to 07/24/2019 with my current Employer A. I am planning to travel to India in Feb 2019, during which I have to get my H1B visa with my current Employer A stamped. Meanwhile I have got a new job offer from Employer B and they are ready to start the H1b visa transfer process soon. They are ready to file a new petition for me and get the petition filed with USCIS. Also they are expecting me to join with the filed petition in March 2019 (even without approval), for which I am ok. Even if the Emploeyer B starts the visa transfer process and file a new petition now , I will be joining Emploeyer B only in March 2019, since I have to travel to India in Feb 2019 during which I have the visa stamping for Employer A. I will resign my job with Employer A only after coming back from India in March 2019. So I want to know whether the new visa transfer and petition filed by Employer B cause any harm to my travel to India, visa stamping process for my current Employer A petition and port of entry while returning back to USA. VISATOUS Posted February 5, 2019 Report Share Posted February 5, 2019 File the Transfer after your travel. If you file your transfer before travel then you may receive transfer approval without i-94. Then you have to leave the country and come back with new valid I-94. Please explain the scenario to your transfer filing lawyer for best advice. Link to comment
