cap exempt H1b transfer with I-140

Just found out about this forum, looks like there are some wonderful resources here.

If an H1b was filed with a cap exempt employer and an I-140 was obtained, should the person want to switch to a new employer, does this new employer have to be cap-exempt as well (does I-140 change things?)  Thank you!
