shaliniraok Posted November 14, 2018 Report Share Posted November 14, 2018 Hi, Planning to go to India for Stamping on Dec 31st 2018, arriving back to the US on Feb 2nd, 2019. I have a H1 valid until March 7th, 2019. I do not have stamping for this H1. I also have an extension approved from March 8th, 2019 to Feb 19th, 2022. Which receipt should I be using for my DS-160 and if I do use the Future H1 which starts from March 8th, 2019, will I be able to come back to US on Feb 2nd. Thanks for the help. Link to comment

You should use the approval doc with date until March 7th, 2019 at the time of stamping. Incase if you go out of country after March 8th, 2019, use the extended i797 with dates March 8th, 2019 to Feb 19th, 2022 for stamping. You can come back on Feb 2nd if you get a stamping until March 7 2019. Incase of POE say that we will not admit you for a month, show them the extension and explain them y do you have to use old petition to get back due to the dates difference. Link to comment

In either case, drop off OR personal interview submit both petitions. Let the consulate decide the visa validity period. Link to comment
