Neha Banthia
1) I understand I have 60 days to find a job, but if I get an offer on 59th day and then company starts my H1B transfer process, is that fine? 2) If my current employer starts my H1B revoke process, will I will face trouble in transferring my visa to another employer? 3) If I have no job for a month now will my H1B transfer need paystubs? Since my most recently paystub will be missing a month? 4) What are my options if I don't get job within grace period? Can I get extension for more than 60 days on my status? 5) What are my options if H1b transfer is rejected? 6) if i was terminated from company "abc" and I find a job within 30 days in company "xyz" and then in future i again get terminated from "xyz" do I get 60 - 30 days grace period or I again get 60 days grace period? JoeF
The new H1 petition should reach USCIS before the 60th day is over. Otherwise, it may be approved for Consular Notification only. The old employer by law has to inform USCIS that you no longer work there. It has no effect on you. Link to comment
Chai
1. USCIS only cares if they have received new H1-B petition within 60 days. 2. No trouble. It takes USCIS 6-8 weeks to act upon the request of H1B revocation after the request is submitted. 3. No. You have to leave the US, unfortunately. 4. Not much options are left as far as employment is concerned. 5. 60- day rule is applicable for each approval validity period. Does not matter if it is 1 year or 3 validity period. Link to comment
Chai
Paystubs within last 45 days are fine. They don’t necessarily include the pay period ending past week preceding application received date. Link to comment
