Payroll running with 2 employers while H1B transfer is still in progress

Hello,

Is it legal to have payroll running with two employers at the same time?

My new employer has filed my H1 petition in the regular process (as premium processing is suspended by USCIS).

While I am planning to join on the receipt notice, is it okay to keep my current employer uninformed (being on vacation) until I get a confirmation on my H1 transfer and temporarily have payroll running with both employers?

 

Please advise.

That would be highly unethical at least, and possibly criminal.

H1 processing takes several months. No employer gives that much vacation.

It is not legal as you need a concurrent H1b for you to be able to work with two employers at a given time. If caught It can and will be seen as unauthorized employment.
